Marble Hill ICE shooting and removal of Oscar Belgal from hospital (Oct. 2026)

Case

On Oct. 8, 2026, an ICE agent fired seven rounds into a car in New York City's Marble Hill neighborhood during a targeted enforcement operation, wounding 28-year-old Oscar Belgal in the neck; his 5-year-old son was in the back seat and was not hurt. That night ICE agents drove Belgal away from the hospital in unmarked vehicles to a facility outside New York, while NYPD arrested four protesters outside. DHS says Belgal was the target of a gang-related operation and had a record; city and state officials are demanding an independent investigation and release of body-camera footage.

What happened (Oct. 8, 2026)
At about 4 p.m. on Oct. 8, 2026, near West 225th Street and Marble Hill Avenue, ICE agents tried to arrest a man in a car with a 5-year-old boy in the back seat. NYPD Commissioner Jessica Tisch said one ICE agent fired seven rounds at the car, striking the 28-year-old driver, Oscar Belgal, in the neck. The child was not injured and was placed in the care of a family member.
Tisch said that when NYPD officers arrived, Belgal was handcuffed and seated on the ground. Officers put him in an NYPD vehicle, rendered aid and took him to NewYork-Presbyterian Allen Hospital with non-life-threatening injuries. NYPD cameras captured the moments leading up to the shooting but not the shooting itself.
Rep. Adriano Espaillat told CBS News he met the 5-year-old and the child's mother at the hospital and that the boy is Belgal's son.
ICE said the operation targeted an undocumented man associated with the Trinitarios gang. DHS described it as a targeted enforcement operation.

Removal from the hospital and protests
Around 11 p.m. on Oct. 8, ICE agents drove Belgal away from the hospital in unmarked vehicles while hundreds of protesters surrounded them. On Oct. 9, DHS Secretary Markwayne Mullin said Belgal had been moved to a more secure facility outside New York State.
NYPD arrested four people outside the hospital for obstructing governmental administration and issued them court appearance tickets.
Darializa Avila Chevalier, a Democratic candidate in New York's 13th Congressional District, said she was among multiple people assaulted by officers of the NYPD's Strategic Response Group at the protest and was knocked to the ground. City Councilmember Carmen De La Rosa said NYPD escalated the situation. These are their accounts.

Official reactions and demands
Mayor Zohran Mamdani called the shooting an outrage.
Gov. Kathy Hochul called for full transparency from federal authorities. She said she spoke with the president and Secretary Mullin, urged them to halt ICE enforcement operations in New York, and asked them to release body-camera footage of the shooting.
Rep. Alexandria Ocasio-Cortez called for a full independent investigation and the immediate release of all body-camera footage.

Perspectives

Official position — ICE and DHS
ICE and DHS say the operation was a targeted enforcement action against an undocumented man associated with the Trinitarios gang. ICE's statement said he was arrested by the NYPD on Dec. 7, 2023 and released a few days later under what it called reckless sanctuary policies, and DHS says the incident remains under investigation. DHS's position is that the shooting happened during a lawful enforcement operation.

Critic — Rep. Alexandria Ocasio-Cortez
Ocasio-Cortez says ICE's presence in New York has been growing more escalatory and dangerous, that the shooting requires a swift response including a full independent investigation and release of all body-camera footage, and that ICE is a rogue, lawless paramilitary and surveillance agency that should be abolished. She also said Target should stop offering Bronx properties as staging sites for ICE; no reporting found for this entry confirms that claim, so it is not stated as fact here.

Editorial read — The Author (site author)
The Author's reading: this is one incident in the field-level enforcement surge that Congress's tens of billions in new ICE money made possible, alongside the detention build-up and the harms to U.S. citizens documented in the linked entries. This is interpretation. The sources here document the shooting, the removal from the hospital and the reactions; none ties this operation to specific funding, and the facts of the shooting remain under investigation with no body-camera footage released.

Note
DHS and ICE say the operation was a targeted enforcement action against a man tied to the Trinitarios gang; the circumstances of the shooting remain under investigation, no body-camera footage has been released, and NYPD cameras recorded the lead-up but not the shooting itself.
